Minutes for July 5, 2000

Campaign Spending Commission Meeting

July 5, 2000

Members Present:
A. Duane Black, Della Au, Clifford Muraoka and Andrea Low

Staff Present:
Robert Watada, Jon Itomura and Ellen Kojima
Pam Toguchi, Deputy Attorney General

Call to Order:
Meeting convened at 3:03 p.m. with Chairman Black presiding.

Consideration of Minutes
Mr. Muraoka moved to approve the minutes of May 9, 2000, Ms Au seconded. Motion carried.

Ms Au moved to approve the minutes of June 13, 2000, Mr. Muraoka seconded. Motion carried.

New Business:
Draft AO 00-07 Candidate Employed in Media
An individual considering elective office requested an opinion on whether his employment in broadcast media would be an issue under the campaign spending law. The opinion advises that under the campaign spending law there is no prohibition that would prevent a person from running for office, however, the FCC does have rules, which the Commission has no jurisdiction, regarding equal time for any direct opponent in an election that may effect a candidate.

Ms Au moved to adopt draft advisory opinion 00-07, Ms Low seconded. Motion carried.

Communications to Commission:
The Governor has signed HB 1984. This bill amended the law to insure that candidates will be able to receive the full contribution limit regardless of any factor causing the term of office to be less than the usual length of term for that office, and require candidates to return residual contributions to donors within four years and in the event of a death of a candidate, residual private contributions are to be returned to the donors within sixty days.

Russ Francis has filed a report, but after a preliminary review the report is still deficient. He has until July 13 to compile with the Order.

Mr. Muraoka moved to recess public session of the meeting and convene executive session to confer with Deputy Attorney General, Ms Au seconded. Motion carried.

Public session reconvened at 3:34 p.m.

No further business to discussion Chairman Black adjourned meeting.
Meeting adjourned at 3:36 p.m.
