Campaign Spending Commission Meeting

Members Present:
A. Duane Black, Della Au Belatti, Clifford Muraoka, Richard Choy

Staff Present:
Robert Watada, Jon Itomura, Ellen Kojima

Call to Order:
Meeting convened at 3:00 p.m. with Chairman Black presiding.

Consideration of Minutes:
Mr. Muraoka moved to accept the minutes of May 8, 2003, Mr. Choy seconded. Motion carried.

New Business:
Conciliation Agreement #03-12 KSF, Inc., Myles Shimokawa & David Fujiwara
Investigation found that during the period of 1996 - 2001 the company, officers and family members made contributions to various candidates in excess of $33,000, and most of these contributions were made to Ben Cayetano ($21,000) and Jeremy Harris ($10,000). Both Myles Shimokawa and David Fujiwara were cooperative during the investigation and admitted that family members had been reimbursed for their contributions. As officers of the company they have agreed to the $16,000 fine for false name and excess contributions.

Mr. Muraoka moved to accept the Conciliation Agreement with KSF, Inc., Mr. Choy seconded. Motion carried.

Conciliation Agreement #03-20 Akinaka & Associates, Ltd. and Robert Akinaka
Investigation found contributions amounting to $34,000 had been given to various candidates, and that most of these contributions went to Ben Cayetano and Jeremy Harris. Further revealed that the officers who made most of the contributions had been reimbursed through payroll bonuses. The parties were cooperative during the investigation and have agreed to a $8,000 fine.

Ms. Belatti moved to accept the Conciliation Agreement with Akinaka & Associates, Ltd., Mr. Muraoka seconded. Motion carried.

Conciliation Agreement #03-21 Hawaii Citizen's Political Committee and Damien Kim
The investigation of this PAC found that there were four PAC 's sponsored by two electrical unions, but only one had made excess contributions. They have agreed to close the inactive PAC's, have only 1 PAC for each separate organization and a fine of $1,000.

Ms. Belatti moved to accept the Conciliation Agreement with Hawaii Citizen's Political Committee, Mr. Choy seconded. Motion carried.

Communication to Commission:
Legislation
HB 401 (Act 117), has been signed by the Governor. This bill places the office within the Department of Accounting and General Services for administrative purposes.
