Campaign Spending Commission Meeting

Call to Order:
Meeting convened at 10:00 a.m. with Chairman Black presiding.

New Business:
Conciliation Agreement 04-07 Nalo Farms and Dean Okimoto
Investigation found an excess contribution of $400 made by Dean Okimoto to the Hannemann campaign committee. Mr. Okimoto agreed to a fine of $500 for the excess contribution.
Mr. Gabrio moved to approve conciliation agreement 04-07, Ms. Chock seconded. Motion carried.
Conciliation Agreement 04-08 Fay Galase
Investigation found two excess contributions to the Hannemann campaign committee made by Fay Galase, an employee at Nalo Farms. One of which was returned as an excess contribution. Ms Galase has agreed to a fine of $1,000.
Mr. Gabrio moved to approve conciliation agreement 04-08, Ms. Chock seconded. Motion carried.
Draft Advisory Opinion 04-03 Disclaimers on Advertising
Draft advisory opinion reiterates that a disclaimer identifying who paid for a political advertisement is required. It also specifies that it must include the name of the person, who is actually paying for the ad and that the address cannot be a post office box, unless it is a committee registered with the Commission and the post office box is the usual address.
Discussion was had on the wording of the draft advisory opinion. After some discussion, staff to make correction to make it clear that ads paid for by anyone other than the candidate the additional disclaimer needs to be included.
Mr. Gabrio moved to approve draft advisory opinion 04-03 as amended, Mr. Olbrich seconded. Motion carried.
Communications to Commission:
Workshops
Candidate workshops have been scheduled as follows: 7/22 - Kona, 7/27 - Kauai, 7/29 - Honolulu, 8/3- Maui and 8/6 - Hilo
Web-Based Filing System
Because of the spending moratorium the funds for the contract to develop the filing system have been frozen. Executive Director to draft a letter from the Commission to the Governor requesting release of funds.
Candidate Expenditures
- Currently reviewing candidate expenditure reports. Some candidate expenditures are for personal benefit. Next meeting will report on candidate reports that present problems.
- Looking to issue an advisory opinion regarding monies candidates receive for campaigning should be used specially for express advocacy of a candidate.
- Staff review of reports - started with larger campaigns
