I Live in a Community Association. Does the Condominium Law Apply to My Association?
No. Community associations that have not been submitted to the Condominium Property Act are not governed by HRS Chapters 514A or 514B. HRS Chapter 421J governs community associations. There is no government agency charged with oversight responsibility of HRS Chapter 421J. The project documents, which you received when you purchased your unit, will indicate whether or not your unit is part of a condominium property regime. The dispute resolution options of mediation or arbitration are nonetheless available for those not residing in a condominium association, as is consultation with a private attorney.
