What is the Condominium Dispute Resolution (CDR) Program?

The CDR program is an administrative hearings process conducted by the Office of Administrative Hearings (OAH) of the Department of Commerce and Consumer Affairs.  Pursuant to HRS § 514B-161 and HRS § 514A-121.5, where a condominium dispute fails to be resolved through mediation (required prior to requesting an administrative hearing), the parties to the mediation may request a hearing through the OAH.  There are parameters for requesting a hearing, set forth in HRS § 514B-161 and HRS § 514A-121.5, and a nominal filing fee of $25.  For more information regarding the hearing process, including who is responsible for costs and attorney’s fees, visit the OAH website at  www.hawaii.gov/dcca/oah/forms/cdr/.  CDR is considered to be a pilot program.  It has been extended to June 30, 2011, at which time the law will be repealed, unless extended further.
