The following are questions that were received about IFB No. AWSBH-200901 and replies provided by DLNR/DOBOR (UPDATED 12/18/09)

1) "For IFB No. AWSBH-200901 it states that the State may cancel the parking agreement for a number of reasons by supplying a 30 day notice to the operator. Does the Operator get the same 30 day cancellation terms to the State?"

ANSWER: No

 

2) We are being asked to give a guaranteed amount in our bid. Normally we would be given past income amounts. I believe that when the current operator was given this contract without it going out to bid it was to see what kind of revenues were possible. Now that it is going out to bid the information regarding income amounts should be shared.

3) Is gross revenue defined as not allowing for credit card fees?

ANSWER: Yes

 

4) Is gross revenue defined as not allowing sales taxes?

ANSWER: Yes

 

5) If so, what taxes and amounts is the State subject to in this lot?

ANSWER: Not relevant to this IFB.

 

6) And what happens if taxes are increased during the term?

ANSWER: Concessionaire will remain responsible for the payment of taxes.

 

7) Shouldn't gross receipts be calculated after taxes and credit card fees?

ANSWER: No. Relevant provisions applicable to each question above, numbers 3 through 7: 1.6: "Gross receipts" means all revenues collected under the Parking Concession Contract prior to the payment of any taxes or other expenses, charges, or assessments, and as described in Section 4.8. 4.8: Gross receipts shall be all gross proceeds, sales, enforcement income or any income whatsoever earned by the Concessionaire resulting from the operation of the parking lot, prior to the payment of any taxes, charges, assessments, expenses, or any other offset other than a valid proper refund to the customer.

 

8) Are the current revenue figures based on the $1.00 per hour rate ($8.00 per day) or are they based on $0.65 per hour ($6.00 per day)?

ANSWER: The current revenue figures are based on $.25 per hour. There is no time limit on parking within the paid parking area as long as fees are paid. There is a 6 hour time limit for vehicles parked within the free public parking area. The Board of Land and Natural Resources authorized increasing the hourly parking rate from $.25 to $1.00. Upon execution of the parking concession contract, the hourly parking rate will be $1.00.

 

9) What is the monthly permit rate? How many monthly permits are there currently and do these vehicles park within the 300 spaces?

ANSWER: The monthly parking permit rates are established under Hawaii Administrative Rules, Section 13-233-29 and are attached below. Currently, there are 144 parking permits issued. Tenants issued a parking permit are encouraged to park within the designated permit areas but may park within the designated 300 spaces as well.

§13-233-29 Eligibility for parking permits; fee per vehicle. (a) Persons eligible for the parking permits described in section 13-233-28 and the fees for the permits are as follows:

(1) An owner holding a valid use permit (permittee) authorizing the mooring of the owner's vessel at the small boat harbor, and any co-owner of the vessel.
$25 per month
(2) The master, spouse of each owner and their legal dependents 18 years of age or older.

(3) An owner or co-owner holding a valid use permit authorizing the mooring of the owner's vessel at the small boat harbor may secure a temporary parking permit, for use by bona fide guests accompanying the owner on board the vessel on a voyage outside the confines of the small boat harbor.
$10 for each 24-hour period or fraction at thereof
(4) An owner or employee of a firm, business, or organization operating under a lease or other agreement authorizing the owner, employee, firm, business, or organization to engage in a business or commercial activity at the small boat harbor.
$90 per month

(b) Fees for permits issued after the first month of a calendar quarter shall be prorated on a monthly basis. (c) Except as provided in subsection (a)(2), not more than one parking permit shall be issued to a person eligible for a parking permit. 10) Please clarify 2.7. It states that Concessionaire will deliver all meters and support poles to DBOR. Are poles to be dug out completely or can we cut them at ground level and smooth over?

ANSWER: The meters and support poles may be cut at the base, and safely capped, in a manner pre-approved by the Chairperson. The relevant provision is as follows: 2.7: Concessionaire shall remove and deliver to DOBOR, at Concessionaire's sole cost and expense, all existing manual coin feed meters and support poles presently located along the Harbor Drive of Holomoana Rd. and replace them with approved pay stations in locations pre-approved by DLNR’s Chairperson.

 

11) What are approved monthly parking rates? Are there Reserved rates, Unreserved rates?

ANSWER: Please see question 9.

 

12) Is the State requesting a minimum guaranteed concession fee of $15,000.00 per month plus a minimum of 70% of monthly gross receipts?

ANSWER: No.

 

13) Or, is the State requesting a minimum guaranteed monthly concession fee of $15,000, or a minimum of 70% of monthly gross receipts, whichever is greater?

ANSWER: Yes. Relevant provisions re questions 10 and 11 above: 4.1.: The Parking Concession Contract fee shall be the bid terms offered by the successful bidder. The monthly payment to be paid to DLNR shall be the minimum monthly payment or the percentage of monthly gross receipts, whichever is greater. [Emphasis in original.] 4.2: The minimum monthly fee as set forth in the successful bidder’s offer shall be not less than FIFTEEN THOUSAND DOLLARS ($15,000). The Concessionaire shall pay to DLNR in advance, without notice or demand, the minimum monthly fee on a monthly basis, on or before the twenty-fifth day of the month preceding the month for which the fee is applicable and due. The first monthly payment shall be made upon execution of the Parking Concession Contract. 4.3: The monthly percentage fee as set forth in the successful bidder’s offer shall not be less than SEVENTY PERCENT (70%) of all gross receipts collected for the month and is to be the product of multiplying the Concessionaire’s total gross receipts for the month by the percentage offered in the Concessionaire’s bid. The Concessionaire shall pay to DLNR, within twenty-five (25) calendar days after the close of each month, the percentage fee in excess of the minimum monthly fee for the prior month.”

 

14) Currently there are only two pay stations that accept credit cards plus four additional pay stations that don't, for a total of six. Under section 2.14.1 and 2.14.3 it states that a minimum of eight pay stations shall be installed and that each pay station must be able to accept credit cards, cash, and coins. Is this correct and/or is there any reason why all of the pay stations are not able to accept credit cards?

ANSWER: The current operation does not necessarily reflect the requirements of the IFB. The relevant provisions of the IFB state: 2.14: The Concessionaire may be required to meet the following equipment requirements pertaining to pay stations described herein. 2.14.1.: A minimum of eight (8) pay stations shall be conveniently installed throughout the harbor, with the locations approved by DOBOR. 2.14.2.: Each pay station shall have clearly posted operating instructions for the public. 2.14.3.: Each pay station must be able to accept credit cards, cash, and coins.

 

15) What is the space count breakdown by type? Free Stalls, Monthly Stalls, Transient Pay stalls, etc.

ANSWER: The allocation of parking stalls is shown on the exhibit in this solicitation (“IFB”) labeled as EXHIBIT "A", and the break down is as follows:


313 stalls are reserved for parking permits
300 stalls are reserved for public use at no charge
300 stalls are reserved for paid parking.


The concessionaire must ensure that the 300 free public parking stalls as well as the designated permit parking stalls are maintained. The selected parking concessionaire is permitted to reconfigure the existing parking scheme to maximize efficiency within the designated area shown on Exhibit "A".

 

16) Does the Operator need to insure all of these stalls or will the State or a combination?

ANSWER: The vendor will need to insure all stalls included within the premises. The relevant provisions are at 8.1 and 8.2.

 

17) Is there power supplied for the Pay Stations or do they need to be Solar capable?

ANSWER: No power is supplied to the pay stations. Solar power capability for the pay stations is an option or the concessionaire may supply power at their expense.

 

18) Are there any specifically required operating hours for the Operator?

ANSWER: The relevant provision is at 2.4 and 2.11: The parking area to be included under the Parking Concession Contract is shown on the exhibit in this solicitation (“IFB”) labeled as EXHIBIT "A", which is to be operated 24 hours a day, 7 days a week. The free public parking area is closed from 10:30 p.m. to 4:30 a.m. and has a maximum six-hour time limit when open. The concessionaire is responsible for enforcing these provisions.

 

19) Is there storage and or office space at the Ala Wai facility available for the Operator’s use?

ANSWER: There is no office space identified in the IFB but the State will work with the selected concessionaire to try and accommodate their needs. The concessionaire will be responsible for including the additional space in their insurance policy.

 

20) Can you verify exactly how this contract will be awarded? Will it be based on highest $$ or highest percentage?

ANSWER: The award of the Parking Concession Contract shall be made to the responsible bidder with the highest minimum monthly fee. If there is a tie in the highest minimum monthly fee offered, the contract shall be awarded to the tied bidder offering the highest monthly percentage. If there is also a tie in the tied bidders' monthly percentage offered, DLNR may reject all bids or may award the contract to the tied bidder who is best qualified by experience and financial means, as determined by the Chairperson.
