Habitat Conservation Plans
Pursuant to Hawaii’s Endangered Species law, Hawaii Revised Statutes (HRS) Chapter 195D, a landowner may seek an Incidental Take License (ITL) from the Department for take of a threatened or endangered species that incidental to an otherwise lawful activity provided that the applicant prepares an accompanying Habitat Conservation Plan (HCP) that meets the requirements enumerated under HRS 195D including measures for avoidance, minimization, mitigation, monitoring, and net recovery benefit to the affected species.
Quick Facts about HCPs and ITLs:
- Take of endangered species is illegal under state and federal law
- HCPs and ITLs provide authorization for take that is incidental to activities that are otherwise legal
- Development of HCPs and ITLs is voluntary
- HCPs and ITLs are jointly processed with US Fish and Wildlife Service
- Minimum of one year for development process
