SUBJECT: Hawai`i Administrative Rules (HAR) Chapters 13-275 through 284

 

Governor Linda Lingle signed the administrative rules for the historic preservation review process on November 25, 2003, and they were filed with the Lieutenant Governor's office on December 1, 2003. The effective date of the rules is therefore December 11, 2003.

As many of you know, I recently provided a summary of the procedures and changes to expect when the rules are signed into law; I focused on specific issues affecting professional archaeologists. With this memorandum, I wish to advise you of the specific dates on which we will begin implementing three of the required procedures.

Beginning Thursday, December 11, 2003, any submittals to our office (including reports and plans) on or after that date will be subject to the specified review time periods and public comment provisions of HAR 13-275 through 284.

Beginning Monday December 22, 2003, any applicable fees must accompany all reports and plans submitted for review. Fees will only be collected at the Kapolei office; please do not send any fees payments to our outer island offices. We will have a cover form (which will be available for downloading and printing from our website at the following URL: blue ball graphic, link tohttp://www. state.hi.us/dlnr/hpd/hpgreeting.htm) which should accompany any submittal that requires a fee payment.

By January 15, 2004, every archaeologist conducting archaeological work in the state must obtain a permit. An annual permit fee of $50 must be submitted along with the requisite documents, including current contact information and a current professional resume. A permit application form will be sent to all firms on our consultants' list and other archaeologists working in the state.
