How do I request a Determination Letter or a Letter of No Effect?


If a State, City/County, or private organization, submit your request by letter addressed to:

Include the following types of information:

 I. GENERAL INFORMATION

a. Agency/Organization Overseeing Project (supplying funds, assistance, license, permit):

c. Contact from Agency/Organization (telephone number, email address):

d. Additional contact persons (may represent applicant, include telephone number, email address):

e. Project Name:

f. Project Street Address:

g. County, City, Zip code:

h. Tax Map Key, Ahupua`a, Island:

i. Area of Potential Effect (APE) (Attach location map, tax map key map, be sure to consider direct and indirect effects of undertaking including visual effects):

j. Project Description [Attach information as necessary, include depth and extent of excavation, height of structures (photo simulation is recommended), any other construction effects (i.e. other buildings, trenching, lay-down areas, access roads etc.), include any plans that are available]:

k. Identification of consulting parties (Attach supporting documentation, invitations to participate to Native Hawaiian Organizations, counties, neighborhood boards, etc. If a National Historic Landmark may be affected, the National Park Service must be notified. Please attach copies of letters.):

 

II. IDENTIFICATION OF HISTORIC PLACES

 Select one:

 _____ a. Historic Properties are located within the project APE.

____ i. Attach supporting materials (photographs, archaeological assessment of inventory survey, date(s) of construction for existing structure(s)).

____ ii. National Historic Landmark located within the APE.

____ ii. residential development/urbanization has altered the land.

____ iii. previous grubbing/grading has altered the land.

____ iv. an acceptable archaeological assessment or inventory survey found no historic properties.

____ v. the existing structure is less than 50 years old (date(s) of construction).

III. DETERMINATION OF EFFECT

Select one:

 _____ a. The determination for the project will be 'no historic properties affected' (i.e., none is present or there are historic properties present but the project will have no effect upon them. Attach supporting documentation).

 _____ b. The determination for the project will be 'no adverse effects' (federal) located within the project APE. Attach supporting documentation.

 _____ c. The proposed undertaking will result in 'an adverse effect' (federal) / 'effect, with proposed mitigation commitments' (state, city and county) to one or more historic properties and the applicant, or other federally authorized representative, will consult with the SHPO and other consulting parties to resolve the adverse effect. Attach supporting documentation and proposed plan to resolve adverse effect(s).




Please affix authorized signature, title of authorized signator and date of the letter.  The State Historic Preservation Office will review and comment on the project. Possible responses are as follows:

_____ Concur with the determination of "no historic properties adversely affected."

_____ Concur with the determination that the project may have "an adversely affect." We look forward to working with you to develop measures to avoid, minimize or mitigate the adverse effects on the historic properties.
