Title I of the ADA prohibits discrimination against qualified individuals with disabilities regarding job application procedures; the hiring, advancement, or discharge of employees; employee compensation; job training; and other terms, conditions, and privileges of employment. Title I applies to private employers, state and local governments with 15 or more employees, employment agencies, labor organizations, and joint labor-management committees.

Title II of the ADA prohibits discrimination against qualified individuals with disabilities in all programs, activities, and services of public entities. It applies to all State and local governments, their departments and agencies, and any other instrumentalities or special purpose districts of State and local governments. It clarifies the requirements of section 504 of the Rehabilitation Act of 1973 for public transportation, whether or not the public entities receive Federal financial assistance. It also establishes detailed standards for the operation of public transit systems, including commuter and intercity rail.

The HDOT Office of Civil Rights (OCR), ADA Specialist, with the assistance from Divisional and Staff Offices, shall ensure that HDOT provides civil rights protection to individuals with disabilities in its programs, services, and activities.
