Proposed Amendment to Chapter 19-16.1 Fees and Charges

Proposed Amendment to Chapter 19-16.1 Hawaii Administrative Rules, Airports System Fees and Charges Applicable to Non-Signatory Carriers.

The State of Hawaii, Department of Transportation, Airports Division (DOTA) is proposing to amend Chapter 19-16.1, Hawaii Administrative Rules (Chapter), to have the fees and charges paid by non-signatory carriers calculated as a percentage of the amount paid by signatory carriers.


This change is necessary to ensure that signatory carriers, which have agreed to make up any shortfall in airport operating revenue, do not pay higher fees than non-signatory carriers which have not made such a commitment.


Currently, the Chapter lists specific amounts that non-signatory carriers are required to pay. Due to the length of time that is required to amend the Chapter, it is not uncommon for the amounts to be less that what they should be.


The proposed amendment sets outs the various costs that signatory carriers pay and method for deriving those costs. It sets the requirement for non-signatories at 125% of the signatory cost.


As part of the process of evaluating the potential impact of amending the Chapter, the DOTA is seeking input from the general aviation community.


While the majority of the cost items are related to terminal building fees and charges, which do not apply to the general aviation community, landing fees is one item which does impact the general aviation community.


Historically, the signatory carriers who fly overseas flights have underwritten the interisland landing fee. This was done through a discount contained in the signatory airline agreement. The current signatory airline agreement reduces the discount by one percent per year.


We have included a complete version of the proposed rule change with language that is to be deleted show in brackets and language to be added underscored.
