A Bill for an Act Relating to Harbors. (HB 216) 

Temporarily exempts the leasing of facilities at Nawiliwili Harbor from the public auction requirements for leasing public lands so that Tesoro Hawaii Corp, which supplies all jet fuel needs for Lihue Airport, can continue to meet current jet fuel requirements.  Act to be repealed on June 30, 2002.

A Bill for an Act Relating to Dillingham Airfield. (HB 1679) 

Amends Chapter 261, HRS, by adding:

Section 261-  Kawaihapai airfield.  The official name of the airfield located at Kawaihapai, formerly known as Dillingham airfield, shall be Kawaihapai airfield. The Act will take effect upon the completion of the transfer of the airfield back to the State by the U.S. Army.

A Bill for an Act Relating to Concessions on Public Property.  (SB 1199) 

Amends Section 102-1 HRS by redefining the word concession as not limited to food and beverage establishments, retail stores, motor vehicle rental operations under chapter 437D, advertising, and communications and telecommunication services.

Amends Section 102-2 by clarifying the bidding shall not apply to concessions or space on public property set aside of parking lot operations at airports, except for motor vehicle rental operations. 

2 November 2001 

A Bill for an Act Relating to Taxation of Transportation Service Providers.  (SB 6  Third Special Session) 

Allows transportation service providers to report under the general excise tax chapter instead of the public service company tax system, which would allow them to pay a four per cent tax based on their actual income for the current period.  This will result in tax savings to them given the anticipated economic climate.

A Bill for an Act Relating to Transportation. (SB 11 Third Special Session) 

Appropriates $10 million out of the airport revenue fund for security measures at state airports. 

Appropriates $2.3 million to establish 36 full time permanent sheriffs position to provide security at HNL.

Appropriates $1.5 million for planning, designing, improving, acquiring, constructing, installing or equipping security improvements at state airports.

Appropriates $13.3 million for planning, designing, improving, acquiring, constructing, installing or equipment airport improvements relating to the renewal, renovation, upgrade or maintenance of facility at various state airports.

A Bill for an Act Relating to Economic Emergency.  (HB 17 Third Special Session) 

Confers temporarily upon the governor certain powers to provide immediate relief to facilitate continuity of business activities and services, minimize employee layoffs, and prevent endangerment of public health, safety or welfare during a period of economic emergency.

The Governor may suspend, waive or defer any contract obligations owed to the State up to April 30, 2002 due to the economic emergency, including airport concessions who meet certain requirements.

Allows the Governor to waive airport landing fees and airport system support charges during the period of economic emergency. 

This Act shall be repealed on April 30, 2002.

A Bill for an Act Relating to Transportation. (HB 1230) 

Makes emergency appropriation for airport security measures.  Appropriates $5.6 million for security measures at HNL, ITO, KOA, OGG, Molokai, Lanai and LIH out of the airport special fund.  Establishes four security positions: 2 at HNL, and 1 each at OGG & for airports administration.

Amends Chapter 261 by adding a new section to establish Passenger facility charge revenue fund. Exempts the fund from Section 36-30 HRS and 103-8.5 HRS.

Section 36-30 HRS was amended to require the passenger facility charge revenue fund to be responsible for its pro rata share of the administrative expenses incurred by the DOT.

Gives the Governor the ability to grant relief in times of economic emergency, by waiving or modifying the terms of an airport concessionaire’s lease and obligations to the State, for those airport concessions which do not contain provisions for relief; and provides the DOT the flexibility to negotiate airport florist and lei greeting service concession leases. Amends Section 102-2 HRS

The purpose of the act is to assist smaller concessionaires by giving the State the flexibility to accept as security for the performance of their concession contracts, legal tender and financial instruments other than performance bonds.  Amends Section 102-11 HRS.

A Bill for an Act Relating to Transportation. (HB 2637) 

The purpose of the Act is to provide the DOT with the flexibility to allow airport concessions to make improvements and the authority to grant short-term extension to concession leases or concession permits within specified parameters in exchange for improvements; and modify and alter older leases and permits by changing the relief terms to similar terms found in newer concession leases that allow a concession to receive economic emergency relief in case of disruptive economic events. The Act is to be repealed on July 1, 2007.

The purpose of this Act is to provide the DOT with the authority to establish and collect a rental motor vehicle customer facility charge dedicated to the renovation and development of rental motor vehicle customer facilities, including, acquisition of property or property rights, acquisition of equipment for and operation of a unified shuttle bus system to and from passenger terminals and rental motor vehicle customer facilities, and design, construction , renovation, operation and maintenance of the rental motor vehicle customer facilities and related services throughout the public airport system for the State of Hawaii.

A Bill for an Act Relating to Airport Concessions.  (SB 1224) 

The major purpose of this Act is to 1) Give the Governor and DOT the discretion and authority to provide relief to airport concessionaires whose leases or contracts with DOT were entered into on or after November 1, 2006, and who spent capital improving the concession premises; or who, as a result of any agreement with DOT pursuant to Act 128 SLH 2006, or Act 201 SSH 2004, spent capital improvement on the concession premises; provided that negotiations for relief for a concession covered by this Act shall commence within 990 days, or any extension agreed to between the governor or governor’s designee and a concessionaire following the mailing by the concessionaire of a written request for relief to the governor; and 2) provide that in seeking relief pursuant to this Act, qualified concessionaires may only seek relief for losses of gross receipts or loss of business which occurred during periods of time starting November 1, 2006, or later.  Takes effect on July 1, 2009 and will be repealed on July 1, 2011.

A Bill for an Act Relating to the Passenger Facility Charge Special Fund. (HB 1166) Effective: July 1, 2009. 

 Amends Section 261-5.5 by replacing subsection b, giving the director of transportation authority to administer the passenger facility charge special fund.  Adds three new sections:

(c) The passenger facility charge shall be a charge for the use and services of an undertaking for the purposes and within the meaning of section39-61(a)(1) and (3).

(d) All moneys paid into the passenger facility charge special fund shall be appropriated, applied, or expended by the department for airport capital improvement program projects approved by the legislature and as permitted under the Aviation Safety and Capacity Expansion Act of 1990, codified as 49 United States Code Section 40117, as amended from time to time.

(e) Any resolution or certificate authorizing any issue of bonds relating to the use of the passenger facility charge for an airport capital improvement program project approved by the legislature may establish other accounts within the passenger facility charge special fund and require the transfer of the passenger facility charge into the other accounts to pay debt service on the related bonds.
