HONOLULU - The Department of Health (DOH) has filed a complaint and
order against Edward Fong, James K.F. Fong Trust, and Dorothy F.M. Fong
Trust (the Fongs) for alleged violations of the state’s solid
waste rules, specifically: 1) mismanagement of solid waste; 2)
operation of an unpermitted solid waste management system; and 3)
improper disposal of solid waste. The violations allegedly occurred at
87-1683 Kapiki Road, Waianae, Hawaii, and the DOH imposed a penalty of
$41,160.00.
The DOH alleges that the site has solid waste in the form of: 90
junk vehicles, twelve 55-gallon drums of used oil, fifty 55-gallon
drums of asphalt, fifty 55-gallon drums containing aircraft oil, a
number of 55-gallon drums labeled “DRY CLEANING FLUID,”
“PERCHLOROETHYLENE,” and “PERCHLOROETHYLENE DRY
CLEANING,” 5-gallon and 1-gallon containers of paint, lead acid
batteries, compressed gas cylinders, and propane tanks.
In addition to paying the penalty, the Fongs have been ordered to
come into compliance with State solid waste rules by ceasing to
accumulate additional solid waste and cleaning the subject property
according to a schedule established by the State.
The Fongs have requested a hearing in response to the complaint but
in the mean time approximately one third of the accumulated waste has
been removed from the property.
