DOH PROPOSES KUALOA WATER POLLUTION CASE SETTLEMENT

The Department of Health (DOH) seeks public comment on a proposed settlement with the City and County of Honolulu (City) regarding alleged wastewater discharges from comfort stations at Kualoa Beach Park in late 2005-early 2007 which resulted in the posting of warning signs for several months because of high bacteria counts in the nearshore ocean waters. In settling the case, the City has admitted to no liability.

The proposed settlement requires that the City seek the necessary approvals to replace the Park's wastewater systems, and to remove wastewater by pump truck until that replacement is completed. The settlement also requires that the City pay $300,000 to settle permit and water quality violations alleged by DOH. The settlement payments shall fund additional water quality monitoring at Kualoa Beach costing $150,000 and shall fund another environmentally beneficial project (or projects) to be designated by DOH also costing $150,000.

This settlement resolves an administrative Notice and Finding of Violation and Order that DOH issued to the City on January 26, 2007.
