NOTICE FOR COVERED ENTITIES

United Pacific Resources sent a letter dated January 16, 2008 to covered entities, which included the following information:

In order to meet the objectives established in Act 290, the state required all state funded agencies and covered entities (non-profit organizations) to submit individual Language Access Plans for approval. However, the deadline for submitting plans was December 31, 2007, last year!


The above information is incorrect.


OLA’s Clarification on Language Access Plans for Covered Entities under Hawai‘i’s Language Access Law.

► All covered entities are required to establish a language access plan under HRS § 371-34.

► Hawai‘i’s Language Access Law does not require covered entities to submit their plans to OLA.  However, OLA has requested covered entities to submit a copy of their completed plans to OLA on a voluntary basis.

► The December 31, 2007 deadline was an internal, OLA deadline and was not a deadline under Hawai‘i’s Language Access Law.  Plans submitted to OLA by this date were included in OLA’s annual report to the Legislature.
