Nineteenth Legislature of the State of Hawaii, Regular Session of
1997, the Senate concurring, that the Legislature supports the
passage of Senator McCain's National Parks Overflights Act of 1997;
and
legislation can be greatly enhanced if all affected parties are
willing to put their best efforts into working together in a spirit
of collaboration to seek ways for all visitors to enjoy our national
parks; and
legislation, it is urged to consider the efforts that have gone into
the development of voluntary agreements worked out between the US
National Park Service and private industry to resolve the overflight

TITLE REQUESTING THE DEPARTMENT OF HEALTH TO ESTABLISH A MENTAL HEALTH
STATUTES TASK FORCE.

DESCRIPT BE IT RESOLVED by the House of Representatives of the
Nineteenth Legislature of the State of Hawaii, Regular Session of
1997, the Senate concurring, that the Department of Health is
requested to establish, within the Department of Health for
administrative purposes only, a task force on involuntary commitment
and treatment for mental illness, which shall be called the " mental
health statutes task force "; and
recommendations for the improvement of the involuntary commitment
and treatment laws in order to reduce the wait lists for proper
mental health treatment in the jails and community, reduce the
number of injuries to patients and staff at the Hawaii State
Hospital, and make the system more efficient; and
legislative proposals seeking to:
involuntary treatment decisions are made expeditiously and
simultaneously in a single hearing when possible, so that
persons with severe neurobiological disorders can receive
persons with severe neurobiological disorders who are in
need of inpatient treatment;
based on the clinical condition of the defendant and the
final disposition of the defendant's case; and
individual rights and due process requirements; and
proposals above, the task force shall consider at least the following
issues:
involuntary treatment when a guardian is lacking or when
the incapacity is not considered permanent;
of initial commitment, for all individuals who need such
treatment, particularly those who also need the treatment
to regain fitness to stand trial or to prevent harm to
themselves or others;
primarily as a means of ensuring a defendant's safekeeping
and appearance in court or as a convenience in
prioritizing criminal cases;
proceed to trial;
inpatient treatment as determined by a medical
professional with appropriate education, training, and
experience;
disorder " for purposes of chapter 704, Hawaii Revised
Statutes;
admission, discharge, and treatment decisions regarding
individuals with a physical or mental disease, disorder,
or defect, which prevents those individuals from being
under section 706-607, Hawaii Revised Statutes; and
standard for use as a basis for involuntary commitment to
ensure humane and adequate treatment for persons who,
unless treated, will continue to a reasonable medical
probability, to physically or mentally deteriorate to the
point where the person will become a danger to self or
others; and
the following matters:
code admission, treatment, and discharge data at the
Hawaii State Hospital from 1975 to the present, noting
significant changes and comparing that data with similar
data from other states and jurisdictions;
individuals, agencies, and courts in connection with
current mental health statutes, with an analysis of the
effect of the interaction between and interdependence of
all interested parties;
trained medical professionals, to assist the Judiciary in
of 11 menbers, consisting of:
Department of Health, Department of the Attorney General,
Department of Public Safety, Office of the Public
Defender, and Office of the Prosecutor;
for psychiatrists;
clinical psychologists;
of Law;
treatment for mental illness; and
commitment and treatment for mental illness; and
seek the participation and advice of the Judiciary in matters of
mutual concern to the task force and the Judiciary; and
members who shall be appointed by the respective department head, and
the member from the University of Hawaii School of Law who shall be
appointed by the Director of Health; and
report which includes its findings and recommendations, and a
proposal for legislative action, to the Legislature no later than
twenty days prior to the convening of the Regular session of 1998.

DESCRIPT BE IT RESOLVED by the House of Representatives of the
Nineteenth Legislature of the State of Hawaii, Regular Session of
1997, the Senate concurring, that the Legislature hereby requests
that the President of the US and the Department of Defense, in
concert with the Japanese Prime Minister, continue their efforts to
negotiate and expedite an agreeable solution for a potential
relocation, adjustment, and realignment of the current presence of
the US military forces in Okinawa, and other Japanese land areas,
with the intent to return land and facilities not needed for direct
military purposes to Okinawa, as recommended by the Final Report of
the Special Action Committee on Okinawa and the Treaty Obligations
to provide the US with land for the defense of Japan; and
Department of Defense are requested to evaluate the distribution of
forces in Japan and Asia, with consideration given to Okinawa's
internal affairs and the international situation, and consider the
possibility of relocating facilities to other areas in Japan and
