MENTAL HEALTH AND SUBSTANCE ABUSE, HEALTH INSURANCE COVERAGE OF. Requests the Auditor to conduct a study assessing the costs of mental health and substance abuse services in Hawaii and the social and financial effects of mandating:

1. All individual, group accident, and sickness insurance policies issued in this State;

2. Individual or group hospital or medical service plan contracts; and

3. Nonprofit mutual benefit association and health maintenance organization health plan contracts,

to include within their hospital and medical coverage benefits for alcohol dependence, drug dependence, and mental illness treatment services that is no less extensive than coverage for any other medical illness, not as an option, for the cost of care for the subscriber or any dependent of the subscriber who is covered by the policy.

Further requests the Auditor to include in the study estimates of the numbers of persons who might benefit from mandated health insurance coverage for mental illnesses and substance abuse, related reductions, or increases in overall health care costs.

Resolves that the study include estimated annual costs, allocated to the separate categories of mental health and substance abuse services, including but not limited to:

1. Providing mandated health insurance coverage for mental illness and alcohol and drug dependence for a minimum of thirty days of in- hospital services per year;

2. Allowing the exchange of each day of in-hospital services for:
   1. Two days of nonhospital residential services;

   2. Two days of partial hospitalization services; or

   3. Two days of day treatment services;

3. Providing a minimum of thirty physician or psychologist visits per year to hospital and nonhospital facilities or visits to mental health outpatient facilities for day treatment and partial hospitalization services;

4. Allowing the exchange of each day of in-hospital services for two outpatient visits;

5. Providing a minimum of twenty-four visits per year for outpatient services; and

6. Providing alcohol and drug dependence benefits that limit the number of treatment episodes but may not limit the number to less than two treatment episodes per lifetime.

Further resolves that the Auditor submit a report of the findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

1. Showcase Hawaii-made products;

2. Develop a marketing plan to promote Hawaii-made or Hawaii-grown products; and

Resolves that the Legislature recognizes the potential of the Filipino- American community, in conjunction with other community groups, government agencies, and private organizations, to help the immigrating children and spouses adjust to their new country and acquire meaningful work that would allow them to contribute to society as a whole.

OCCUPATIONAL THERAPISTS, NEED FOR THE REGULATION OF. Requests the Auditor to perform a sunrise review of the regulation of occupational therapy practitioners, and in particular to study, assess, and report on:

1. The probable effects of regulating the practice of both occupational therapists and occupational therapy assistants in Hawaii;

2. Whether doing so would be consistent with the policies set forth in section 26H-2, Hawaii Revised Statutes; and

3. The preferred form through which such regulation should be provided, if appropriate.

Further requests that in conducting this study, the Auditor consider the form of regulation proposed by the Occupational Therapy Association of Hawaii as contained in H.B. 1099 H.D. 1 (1997).

Supports the passage of Senator McCain's National Parks Overflights Act of 1997, and resolves that the impact of this proposed legislation can be greatly enhanced if all affected parties are willing to put their best efforts into working together in a spirit of collaboration to seek ways for all visitors to enjoy our national parks.

Further resolves that as Congress reviews this legislation, it is urged to consider the efforts that have gone into the development of voluntary agreements worked out between the United States National Park Service and private industry to resolve the overflight problem.

MENTAL ILLNESS, INVOLUNTARY COMMITMENT AND TREATMENT FOR. Requests the Department of Health to establish, within the Department for administrative purposes only, a task force on involuntary commitment and treatment for mental illness, to be called the mental health statutes task force.

Requires the task force to make recommendations for the improvement of the involuntary commitment and treatment laws in order to reduce the wait lists for proper mental health treatment in the jails and community, reduce the number of injuries to patients and staff at the Hawaii State Hospital, and make the system more efficient.

Also requires the task force to develop legislative proposals seeking to:

1. Ensure that both involuntary commitment decisions and involuntary treatment decisions are made expeditiously and simultaneously in a single hearing when possible, so that persons with severe neurobiological disorders can receive medically appropriate treatment in a timely manner;

2. Ensure that criminal court commitment is limited to persons with severe neurobiological disorders who are in need of inpatient treatment;

3. Assure that hospital lengths of stay are appropriate, based on the clinical condition of the defendant and the final disposition of the defendant's case; and

4. Ensure that our mental health statutes safeguard individual rights and due process requirements.

Also requires that in developing the legislative proposals above, the task force consider at least the following issues:

1. Feasibility of a formalized guardianship and conservator system for individuals with permanent incapacity;

2. Administrative reviews allowing authorization of involuntary treatment when a guardian is lacking or when the incapacity is not considered permanent;

3. Judicial authorization of medical treatment, at the time of initial commitment, for all individuals who need such treatment, particularly those who also need the treatment to regain fitness to stand trial or to prevent harm to themselves or others;

4. Prohibiting the use of hospitals or healthcare facilities primarily as a means of ensuring a defendant's safekeeping and appearance in court or as a convenience in prioritizing criminal cases;

5. Periodic judicial review of those persons found unfit to proceed to trial;

6. Criminal commitments based primarily on a current need for inpatient treatment as determined by a medical professional with appropriate education, training, and experience;

7. Exclusion of intoxication from the definition of "mental disorder" for purposes of chapter 704, Hawaii Revised Statutes;

8. Creation of a psychiatric security review board to make admission, discharge, and treatment decisions regarding individuals with a physical or mental disease, disorder, or defect, which prevents those individuals from being responsible for their behavior;

9. Appropriate use of civil commitment in lieu of prosecution under section 706-607, Hawaii Revised Statutes; and

10. Development of criteria for a "gravely disabled" standard for use as a basis for involuntary commitment to ensure humane and adequate treatment for persons who, unless treated, will continue to a reasonable medical probability, to physically or mentally deteriorate to the point where the person will become a danger to self or others.

Also requires the task force to consider the following matters:

1. Constitutionality of broadening the civil commitment standard under section 334-60, Hawaii Revised Stautes;

2. Comparative analysis of voluntary, involuntary, and penal code admission, treatment, and discharge data at the Hawaii State Hospital from 1975 to the present, noting significant changes and comparing that data with similar data from other states and jurisdictions;

3. Processes and procedures currently in use by all individuals, agencies, and courts in connection with current mental health statutes, with an analysis of the effect of the interaction between and interdependence of all interested parties;

4. Establishment of court clinics, staffed with appropriately trained medical professionals, to assist the Judiciary in cases where mental illness is a factor; and

5. Annual mental health law conferences.

Also requires the task force to be composed of eleven members, consisting of:

1. Five members from government including one member each from the Department of Health, Department of the Attorney General, Department of Public Safety, Office of the Public Defender, and Office of the Prosecutor;

2. One member from a professional medical association for psychiatrists;

3. One member from a professional association for clinical psychologists;

4. One member from a nonprofit or advocacy organization representing the interests of persons with mental illness;

5. One member from the University of Hawaii Richardson School of Law;

6. One member who is a recipient of involuntary commitment and treatment for mental illness; and

7. One member of the family of a recipient of involuntary commitment and treatment for mental illness.

Also requires the task force to invite and seek the participation and advice of the Judiciary in matters of mutual concern to the task force and the Judiciary.

Resolves that except for the governmental members to be appointed by the respective department head, and the member from the University of Hawaii School of Law to be appointed by the Dean of the law school, all members to be appointed by the Director of Health.

Requires the task force to submit a report which includes its findings and recommendations, and a proposal for legislative action, to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

UNITED STATES MILITARY PRESENCE IN OKINAWA, EVALUATION OF. Requests the President of the United States and the Department of Defense, in concert with the Japanese Prime Minister, to continue their efforts to negotiate and expedite an agreeable solution for a potential relocation, adjustment, and realignment of the current presence of the United States military forces in Okinawa, and other Japanese land areas, with the intent to return land and facilities not needed for direct military purposes to Okinawa, as recommended by the Final Report of the Special Action Committee on Okinawa and the Treaty Obligations to provide the United States with land for the defense of Japan. Further requests the President of the United States and the Department of Defense to evaluate the distribution of forces in Japan and Asia, with consideration given to Okinawa's internal affairs and the international situation, and consider the possibility of relocating facilities to other areas in Japan and Asia.

Also requests that they research the following issues:

1. The extent of the promise(s) given to the residents by the Department of Housing and Urban Development, the Hawaii Housing Authority, and any other relevant agency concerning the nature of their tenancy (i.e., promises to lease or to provide "buy back" provisions);

6. Whether the consent of the Office of Hawaiian Affairs is necessary as a condition precedent to the sale or lease of the site;

7. The circumstances, if any, under which the Office of Hawaiian Affairs will agree to the sale or lease of the site;

8. The extent of options which are available to the residents via the private sector (e.g., self-help housing, mutual housing, etc.);

9. The residents' financial plan that addresses the following scenarios:
   1. The purchase of the subject land;

   2. The leasing of the subject land; and

   3. The renovation of the existing units;

10. Whether title insurance and mortgage financing will be available for developments on ceded land given the existing litigation;

11. Any other relevant and indispensable issues;

12. That residents show that they can purchase the units;

13. That residents provide HHA with a result of the votes of the resident body regarding how many want to purchase the units and how many do not;

14. That residents provide HHA with the results of a vote of the resident body regarding how many want modernization of the units and how many do not; and

15. Whether HUD will permit the Waimanalo Housing project to de-program for modernization.

Also requests the aforementioned parties to complete their research and findings prior to May 1, 1997, in order to prevent the lapsing of 8 million dollars in federal funds designated for the renovation of Waimanalo Homes.

Resolves that the Hawaii Housing Authority compile and transmit such research and findings to the Legislature on or before May 1, 1997.

2. Examine alternatives to the present system, in particular the recommendations that the state and county planning agencies jointly put forth, and, if warranted, propose changes; and

3. Recommend legislation to implement the proposed changes, or, if that is not possible in the time available, report progress and recommend next steps.

Resolves that there be ten members of the Committee to be appointed as follows:

1. Five members to be appointed by the Speaker of the House of Representatives from among the membership of the House, with one member to be designated by the Speaker as co-chair of the Committee; and

Resolves that the group include the Department of Health, the Department of Agriculture, the Hawaii Forest Industry Association, Hamakua Timber, the Rural South Hilo Community Association, the North Hilo Community Council, the Hamakua District Development Council, Kamehameha Schools Bishop Estate, New Oji Paper Co. Resolves that the main focus of this group is to have a dialogue on how all parties can best work together and that the group examine:

1. The overall plans for developing the commercial forest industry in the Hilo-Hamakua region from the initial stages of land clearance and tree planting to the harvest of timber;

2. The economic impacts that this industry is expected to have on the community in terms of job opportunities, job stability, secondary benefits, and so forth; and

3. The opportunities available to the community to have input on the development of this industry.

Further resolves that the Hawaii Forestry and Communities Initiative work with the other partners to assure that forestry solutions in the Hilo-Hamakua community are socially, culturally, and economically workable.

Further resolves that this group, like any other community organization, is free to participate in any existing regulatory or decision making process as determined by its members.

Further requests the Department of Land and Natural Resources to submit a report summarizing the findings of the group to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

HUNTING AREA RESERVES COUNCIL, ESTABLISHMENT OF. Requests the Department of Land and Natural Resources to work with hunting organizations throughout the

State as well as other users of forest lands to discuss the feasibility of establishing a Hunting Area Reserves Council and that the discussion focus on:

1. The primary duties and responsibilities of the Council;

2. Its composition in terms of type of expertise as well as geographic representation; and

3. Any other pertinent issues.

Resolves that the Department submit a report of its findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

HAWAIIAN LANGUAGE IMMERSION PROGRAM, LONG-RANGE FINANCIAL AND OPERATIONAL PLAN FOR. Resolves that the Department of Education, in conjunction with Aha Kauleo Kaiapuni Hawaii (the Hawaiian Language Immersion Advisory Council), develop a long range financial and operational plan to ensure the development of the Program.

Further resolves that the Department and Aha Kauleo Kaiapuni Hawaii immediately focus on the implementation of the following recommendations found in the Plan:

1. Establish a plan of action to attain the vision and goals of the Program to include a timeline of specific activities and a projection of resource requirements;

2. Collaborate and consolidate the efforts of the Office of Hawaiian Affairs, the Board of Education, the University of Hawaii, Aha Punana Leo, and other interested Hawaiian organizations, businesses, and individuals to support the Program; and

3. Make a concerted effort to provide financial support, growth, and maintenance, especially seeking alternative sources of funding from the private sector from sources such as matching funds, sustained grants from the Office of Hawaiian Affairs, and the federal government.

Further resolves that in addition to ensuring the development of the Program, the long range financial and operational plan also include a study that:

1. Determines the current number of students in each of the Punana Leo and Hawaiian language immersion schools, the current number of students that are on waiting lists for these schools, and the general region of the island from which they would travel to school;

2. Estimates future changes in the number of students on the waiting lists;

3. Assesses the potential size of enrollment in existing Hawaiian language immersion schools if sufficient funding were available; and

4. Identifies sites on each island where additional Hawaiian language immersion schools may be situated if projected enrollment exceeds available classroom facilities.

Further resolves that the Department and Aha Kauleo Kaiapuni Hawaii submit the long range financial and operational plan to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

LEEWARD OAHU, HIGHWAY FOR. Resolves that the Department of Transportation give priority to the development of a mauka highway as an alternative to Farrington highway on the Leeward Coast.

Further resolves that the Department work with the Oahu Metropolitan Planning Organization to include this mauka highway project on the Oahu Transportation Improvement Program list to be eligible for federal construction funds.
