Further requests that in conducting this study, the Department include an evaluation of the available scientific literature for the possible health effects of aerial spraying of glyphosate and other herbicide compounds as it may specifically apply to:

1. The Hamakua region on the Island of Hawaii; and

2. The efforts to eradicate marijuana plants.

Resolves that the Senate incorporate within the rules of Senate a rule stating that whenever the Senate's obligation to advise and consent to any nomination made by the Governor under the Constitution of the State of Hawaii is in any way impaired by an improper nomination, a request to withdraw the nomination be immediately made to the Governor by resolution.

DENTAL HEALTH CARE, IMPACT OF PROVIDER REIMBURSEMENT ASSIGNMENT PRACTICES. Requests the Legislative Reference Bureau (LRB) to conduct a study of the impact of provider reimbursement assignment practices of health insurers, health/dental plans, HMOs (health maintenance organizations), mutual benefit societies, dentist sponsored plans, IPAs (individual physicians associations), government, and employer plans, and other organizations providing dental health care coverage in Hawaii, on dental care benefits, costs, billing practices, competition, and quality of care.

Resolves that the study include but not be limited to:

1. Descriptions and comparisons of the quality, accessibility, costs, and choices of dentists' services in other states utilizing a system similar to the current system in Hawaii;

2. Descriptions and comparisons of "freedom of choice", "equal reimbursement", or other similar statutes that have been adopted in other states that mandate equality of payments by health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans to any dental patients;

3. Analysis of the effect in other states of the adoption of "freedom of choice", "equal reimbursement", or other similar statutes, upon the quality, accessibility, costs, and availability of dentists' services, and the dental coverage provided by health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans;

4. A determination of the expected impact in Hawaii on the cost, utilization, and scope of dentists' services and coverages provided by health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans in the event health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans are authorized by the patient to pay directly to nonparticipating dentists, the amount of a claim under the same payment schedule and criteria that would have been paid to participating dentists, under a preferred provider contract;

5. An assessment of whether passage of legislation in Hawaii, in which health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans are compelled to pay directly to nonparticipating dentists, the amount of a claim under the same payment schedule and criteria that would have been paid to participating dentists, under a preferred provider contract, would conflict with federal or state statutes or regulations concerning competition;

6. An assessment of whether passage of legislation in Hawaii, in which health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans are compelled to pay directly to nonparticipating dentists, the amount of a claim under the same payment schedule and criteria that would have been paid to participating dentists under a preferred provider contract, would reduce the competition between companies, or cause existing companies to go out of business, by the examination of states that have enacted "freedom of choice" legislation;

7. An assessment of whether passage of legislation in Hawaii, in which health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans are compelled to pay directly to nonparticipating dentists, the amount of a claim under the same payment schedule and criteria that would have been paid to participating dentists under a preferred provider contract, would cause dental fees to rise significantly, by the examination of states that have enacted "freedom of choice" legislation;

8. An assessment of whether passage of legislation in Hawaii, in which health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans are compelled to pay directly to nonparticipating dentists, the amount of a claim under the same payment schedule and criteria that would have been paid to participating dentists under a preferred provider contract, would eliminate the incentive for a dentist to participate with a plan, thereby reducing access and quality while raising costs; and

9. An assessment of the following additional mechanism to increase access to quality dental care for privately and publicly funded dental plans consumers, should direct and equal reimbursement become law: A licensed dentist may not exclude from their practice any patient requesting care who provides existence of coverage from a health insurer, health/dental plan, HMO, mutual benefit society, dentist sponsored plan, IPA, government, or employer plan, regardless as to the dentist's participating status with that plan.

Further resolves that the LRB conduct this study in consultation with: the Office of Consumer Protection; the Department of Commerce and Consumer Affairs; the Insurance Commissioner; the Department of Labor and Industrial Relations; the Chief of the Dental Health Division, Department of Health; other relevant and public agencies; the Hawaii Dental Association; the Hawaii Medical Service Association; Hawaii Dental Service; other relevant private health insurers, health/dental plans, HMOs, mutual benefit societies, dentist sponsored plans, IPAs, government, and employer plans, and other relevant private sector organizations providing dental care coverage or information thereof.

Further resolves that the LRB conduct this study using to the extent available, valid standards of measure, state experience, and other data sets.

Further resolves that responses to specific findings and conclusions of the study by the primary parties involved be included in the study report.

Further resolves that the LRB submit a report of its findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

PROCESS SERVERS, POLICIES REGARDING. Requests the Department of Public Safety to review and assess its policy regarding the issuance of badges and/or identification cards to those who have completed training in serving legal documents.

Resolves that the Department submit a report, including suggested amendments to the Hawaii Revised Statutes which will reflect the Department's recommendations for more effective service of process, to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

Further requests the Department to issue appropriate interim identification cards to process servers for their presentation upon request when serving process.

HALAWA VALLEY, MOLOKAI, FLIGHTS IN. Requests the Federal Aviation Administration to study the feasibility of installing appropriate navigational aids to assist pilots, or the establishment of a policy to ban flights in Halawa Valley.

Further requests the Administration to report findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 1998.

Urges the members of Hawaii's congressional delegation to exercise their best efforts and to do all things necessary to help facilitate this important safety effort by the Federal Aviation Administration.
