Opinion Letter No. 07-03
February 13, 2007
The Office of Honolulu City Council Member Donovan
Dela Cruz asked OIP for an opinion concerning whether the Council
must accept oral testimony on: (1) an agenda item that has been
cancelled, and (2) an agenda item of which the Council considers
but postpones further consideration.
OIP opined that the Council is not required to accept
oral testimony on an agenda item that is cancelled before the Council
considers it. As for any agenda item of which the Council has begun
consideration but defers further action to another meeting or indefinitely,
the Council must accept oral testimony on such item.
