Department of Public Safety Policy and Procedure Manual
The Department of Public Safety must permit inmates
in State correctional facilities to inspect and
copy the table of contents to the Department’s policy and
procedure manual. After examining the
table of contents to the policy and procedures manual, the OIP concluded
that the public disclosure of
the policy headings and policy numbers would not result in the frustration
of a legitimate government
function. Specifically, using a test set forth in a previous advisory
opinion concerning corrections
policies and procedures, the OIP found that disclosure of the table
of contents would not frustrate
prison security policies, or measures designed for the control of
inmates, by permitting inmates to
violate corrections policies and simultaneously avoid detection.
