Bar Examinations
Applicants’ rights to inspect and copy their
bar examination scores and answers, and the correct
answers, are governed by laws other than the UIPA. The UIPA applies
only to government records
that are maintained by an "agency," which excludes records
relating to the "nonadministrative
functions" of the State courts. The OIP found that records
containing bar examinations scores and
answers are related to those "nonadministrative functions."
Consequently, access to those records
falls under disclosure provisions other than those under the UIPA.
